The petitioner seeks bail in Singhia P.S. Case No. 189 of 2020, registered for the offence punishable under Sections 461, 379, 411 and 34 of the Indian Penal Code. As per the prosecution case, this petitioner was apprehended while committing theft and on search, cash, ornaments, mobiles and iron rod meant for breaking locks were recovered.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case by the police in collusion with the informant on account of business rivalry, as petitioner is also a shopkeeper having shop at Lal Chowk, Rosera and falsity of the case is evident from the fact that informant Anmol Poddar had filed two cases bearing Rosera PS
Patna High Court CR. MISC. No.50296 of 2021(2) dt.26-11-2021 2/2 Case No. 386 of 2020 dated 11.12.2020 under Section 380/457 of the IPC against unknown and the present case bearing Singhia PS Case No. 189 of 2020 dated 12.12.2020 under Section 379 and other allied sections of IPC on two consecutive dates. Petitioner is in custody since 13.12.2020. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Rosera, Samastipur in connection with Singhia P.S.
