JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with NDPS Case No. 14 of 2017 arising out of Barauni Rail P.S.Case No. 111 of 2017 registered under Sections 8 and 20(b)(ii)(c) of the N.D.P.S.Act.

Allegation in brief is that petitioner was found in possession of 70 Kg. Of Ganja carrying in two boxes. Submission is that petitioner is a poor labourer and he was only sitting on the sealed boxes in the parking area of Barauni Railway Station and police falsely implicated him and also recorded his confessional statement and he has been in custody for last one year.

Having considered the recovery of commercial quantity of Ganja and the report of the trial court, as trial is likely to be disposed of within six months, so prayer of bail of the petitioner

Patna High Court Cr.Misc. No.13591 of 2018(5) dt.21-06-2018 2/2 is presently rejected.

Trial court is directed to conclude the trial, as submitted by the court, preferably within six months on day-to-day basis. If trial does not get concluded within stipulated period, petitioner may renew his prayer of bail.
