Petitioner seeks bail in a case registered under sections 47A and 47 (F) of the Excise Act.

70 liters country made liquor and 6000 kg mahua are said to have been recovered from a Bahiyar.

Petitioner was neither caught on the sot nor anything was recovered from his conscious possession. Petitioner does not have any criminal antecedent and is languishing in jail custody since 30.8.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K.Pandey, Judicial Magistrate, Ist Class, Bhojpur at Ara/ concerned court in Tr. No. 583/2016, Excise Case no. 71/2005.
