JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for offences punishable under Sections 328, 304, 120B, 34 of the Indian Penal Code and Section 50(a)(b)(c) of the Bihar Prohibition and Excise Act, 2016.
As per allegation, 30 liters of country made liquor have been recovered from the possession of the petitioner. Petitioner claims his antecedent to be clean save and except stated in paragraph no.3 which arises out of the same occurrence. It is contended that main accused Nagina Pasi and other co-accused persons, who are on similar footing, have
Patna High Court Cr.Misc. No.31946 of 2017 (2) dt.13-07-2017 2 / 2 already been granted bail by different co-ordinate Benches of this Court vide Annexure 2 series. Petitioner is in custody since 05.11.2016.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No.348 of 2016.
Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
