ANJANA MISHRA ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 27(b)(ii), 27(d), 28 of the Drugs and Cosmetics Act. Learned counsel for the petitioner submits that thought allegation has been made against the petitioner of running an unlicensed medicine shop. The medicines so recovered from the shop were not found to have been expired medicines and they have been found to be authentic in nature. Since the said shop of the petitioner is located in small suburban of the village and is possessing only basic medicines and that the petitioner has not caused any damage to any person by selling medicines from his

Considering the aforementioned fact and also the fact that no harm has been caused to any anyone by the medicines, let the petitioner Firoz Alam, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.D.J. 1st, Siwan in connection with C-II 169/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
