JUSTICE PRAVEEN KUMAR ORAL ORDER 17-06-2026 Both applications are arising from the same P.S Case i.e. Majorganj P.S. Case No. 130 of 2026, hence, both are being heard together and are being decided by a common order.

2. Heard learned counsel for the petitioners and learned A.P.P for the State.

3. The petitioners have preferred these applications

Patna High Court CR. MISC. No.39093 of 2026(2) dt.17-06-2026 2/3 for grant of regular bail in connection with Majorganj P.S. Case No. 130 of 2026 registered for the offences punishable under Sections 317(5) of the B.N.S.

4. As per the prosecution case, during the vehicle checking, the petitioners were found seated on a motorcycle. On query, they did not produce any document in support of the ownership of the motorcycle on which they were found siting.

5. Learned counsel for the petitioners has submitted that the petitioners are innocent and have been falsely implicated in the present case. Learned counsel for the petitioner has further submitted at the bar that the charge sheet has been filed in this case and the police has not come out with a case that any case was registered as regards the theft of the motorcycle. It has also been submitted that the procedure prescribed under Section 105 of the B.N.S.S. has not been followed. Lastly, it has been submitted that Vivek Kumar Yadav (petitioner) has clean criminal antecedent whereas Bulbul Kumar (petitioner) has one criminal antecedent and they are in custody since 10.04.2026.

6. Learned APP for the State has vehemently opposed the prayer for bail of the petitioners.

7. Heard the parties and perused the record.

8. Considering the above facts and circumstances of

Patna High Court CR. MISC. No.39093 of 2026(2) dt.17-06-2026 3/3 the case, let the petitioners above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi, in connection with Majorganj P.S. Case No. 130 of 2026.
