JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Mehdiganj P.S. Case No. 2 of 2017 for the offence under Sections 293, 294, 354, 436, 385, and 504/34 of the Indian Penal Code.

The allegation against the petitioner is that in order to malign the prestige of informant and her family members, the petitioner and other co-accused have written filthy things and pasted on the wall of the house of the informant and also on the wall of her neighbour.

Counsel for the petitioner submits that in the present case, FIR was lodged after 11 days delay and the petitioner has falsely been implicated in this case only because he was bailor in

Patna High Court Cr.Misc. No.27263 of 2017 (2) dt.01-07-2017 2/2 Mehdiganj P.S. Case No. 35 of 2016 for Suraj Kewat. Having regard to the nature of allegation and considering the fact that petitioner has surrendered on 13.3.2017 and he was remanded in the instant case on 31.3.2017, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Patna City, in connection with Mehdiganj P.S. Case No. 2 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
