The petitioner seeks bail in connection with Suiya P.S. Case No. 26 of 2020 registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted that the petitioner has falsely been implicated and except suspicion, there is no objective material to connect the petitioner with the alleged occurrence. The thrust of accusation is against co-accused Kailash Rout who is said to be the main assailant, having fired upon the deceased. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner has got no any criminal antecedent
Patna High Court CR. MISC. No.37378 of 2020(3) dt.02-03-2021 2/2 mentioned in paragraph-3 of the bail petition. Learned counsel for the petitioner further submits that the petitioner is in jail custody since 24.04.2020. Similarly situated co-accused has been granted bail by this Co-ordinate Bench of this Court vide order dated 22.02.2021 passed in Cr. Misc. No.34023 of 2020. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Banka in connection with Suiya P.S. Case No. 26 of 2020.
