Petitioners seek regular bail in a case registered for the offence punishable under Section 370/34 of the Indian Penal Code and u/s 79 of the Juvenile Justice Act.

As per the prosecution case, these petitioners were found along with children to whom the petitioners were carrying to Delhi for work in the factories.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that the parents of the children have not stated that petitioners had induced the children to go to Delhi

Patna High Court CR. MISC. No.50315 of 2021(2) dt.29-11-2021 2/2 nor any child has stated that the petitioners were involved. Petitioners claim clean antecedent and are in custody since 29.06.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonpur, Saran in connection with Sonpur (Hajipur) Rail PS case No.56/2021.
