====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511,323 and 506 of the Indian Penal Code.
It is alleged that the petitioner entered into the house of the informant and tried to ravish her when protest was made by the husband and son of the informant they were assaulted. It is submitted by the learned counsel for the petitioner that for the initial occurrence of 8.9.2014 the complaint was filed on 15.9.2014 which came to be registered as police case on 12.3.2015 whereas on the report of the petitioner side, 107 Cr.P.C. proceeding was recommended by the police on 16.9.2014. It is further submitted that there has been no medical examination of
Patna High Court Cr.Misc. No.32149 of 2015 (2) dt.06-08-2015 2/2 the informant. Though the informant claims to be aged 45 years but in the voter list her age has been recorded as 57 years whereas the petitioner is aged 22 years.
Considering the accusation being levelled in the background of 107 Cr.P.C. proceeding pending between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Falka P.S. Case No.51 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
