JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 467, 468, 414 and 120B of the Indian Penal Code. Allegation against petitioner is that from the dickey of his motorcycle bundle of paper along with currency five plus five in both side of bundle with denomination Rs.500/- have been recovered. It is alleged that he used to deal in fake currency note. It has been submitted on behalf of petitioner that he is in custody since 28.8.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. It is not a case of counterfeit currency. He has been made accused due to mistake of fact.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.51471 of 2016 (2) dt.06-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case no. 358 of 2016.
