JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------------ 21-06-2017 Since both the aforesaid applications arise out of the same P.S. Case bearing Gauri Chak P.S. Case No.289 of 2016 registered under Section 379 of the Indian Penal Code, therefore, both the aforesaid applications have been heard together and are being disposed of by this common order.
Patna High Court Cr.Misc. No.17637 of 2017 (3) dt.21-06-2017 2/2 Learned counsel appearing on behalf of the petitioners submits that on the basis of the written report of the informant Ravi Kumar regarding the theft of his tractor, the present case was lodged against unknown on 09.12.2016. In course of investigation, one Md. Tabij alias Shaukin confessed his guilt and disclosed the involvement of the petitioners in the commission of the alleged offence in his confessional statement. Thereafter, the petitioners, who were in custody in connection with Dhanarua P.S. Case No.545 of 2016, were remanded in the present case on 02.01.2017.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate, First Class, Patna City, Patna, in connection with Gauri Chak P.S. Case No.289 of 2016. Out of the two sureties, one must be close relative of the petitioners, who will file an affidavit giving genealogy as to how he/she is related with the petitioners. The bailors will undertake to furnish information to the court about any change in the address of the petitioners. (Rajendra Kumar Mishra, J) P.S./- U T
