The petitioner seeks bail in Falka P.S. Case No. 111/2019, instituted for offences under Section(s) 399 and 402 of the Indian Penal Code read with Section 25(1-b)A, 26 and 35 of Arms Act.

It is alleged in the written report that on getting secret information that some persons have assembled at the door of one Rajesh Yadav for committing crime, the police party reached at the place of occurrence. Some persons started running away seeing the police party but on chase three persons were arrested, who disclosed their name as Rajesh Yadav, Sanoj Kumar Mandal and the petitioner. On search, the police recovered one knife and one mobile phone from possession of

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. There is no recovery of any firearm from possession of petitioner. Petitioner is in custody since 07.04.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth, Katihar, in connection with Falka P.S. Case No. 111/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
