JUSTICE GOPAL PRASAD ORAL ORDER 20-05-2015 In pursuance of order dated 24.04.2015, petitioner and opposite party no. 2 both are present in chamber. Learned counsel for the petitioner submits that petitioner is not ready to keep the opposite party no. 2. It is further submitted that petitioner has already paid maintenance to opposite party no. 2 as decided in maintenance case.
Opposite party no. 2 submits that she wants to live in the matrimonial house.
Having regard to the facts and circumstances of the case, the above named petitioner shall be granted provisional bail for three months on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri M. K. Srivastava, Judicial Magistrate, 1st Class,
Patna High Court Cr.Misc. No.34347 of 2014 (4) dt.20-05-2015 Madhubani, in connection with Complaint Case No. 191 of 2012, subject to condition that petitioner will allow the opposite party no. 2 to live in the matrimonial house with due dignity and honour and not to subject her to cruelty and to continue pay maintenance per month as decided in maintenance case. The trial court after due verification of this fact shall confirm the bail bond of the petitioner.
The violation of any condition shall be liable for cancellation of bail bond of the petitioner.
