The petitioners have filed the instant application for grant of regular bail in connection with C2 Case no. 291 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case 108 litres of Nepali Saufi wine is stated to have been recovered from the possession of the petitioners.

It is submitted by learned counsel for the petitioners that no recovery as alleged has taken place. They have been falsely implicated in the case. They are in custody

Patna High Court CR. MISC. No.41131 of 2020(2) dt.18-03-2021 2/2 since 14.8.2020 and have no criminal antecedent. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioners' period in custody and not having criminal antecedent, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to be enlarged on bail in connection with C2 Case no. 291 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-IInd-cum-Special Judge, Excise Act, Sitamarhi.
