2. The petitioner is seeking regular bail in connection with Rupaspur P.S. Case No. 1019 of 2023 for the offences punishable under Section 306 of the Indian Penal Code.

3. Prosecution case in short is that, the husband of the informant was found lying dead on the roof of the petitioner. The offshoot of the occurrence is said to be illicit relation of the deceased with the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner is second wife of the deceased and informant is the first wife. He has also submitted that there is nothing in the case diary, which shows

Patna High Court CR. MISC. No.43624 of 2024(5) dt.26-09-2024 2/2 that the petitioner has abated the deceased to commit suicide. The independent witnesses in paragraph nos. 43 and 44 of the case dairy have stated only that the petitioner and her husband (the deceased) used to quarrel each other.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. There is nothing in the entire case dairy showing the involvement of the petitioner in abating the deceased to commit suicide.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Danapur in connection with Rupaspur P.S. Case No. 1019 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
