The petitioner, namely, Rus Mohammad in Cr. Misc. No. 31089/2015 and the petitioners, namely, Mokhtar Miyan and Dil Mohammad in Cr. Misc. No. 31099/2015 apprehend their arrest in Turkaulia (Banjaria) P.S. Case No. 407/2014 registered

Patna High Court Cr.Misc. No.31089 of 2015 (2) dt.30-07-2015 2/2 under Section 307 and other sections of the Indian Penal Code. Petitioners Rus Mohammad and Faujdar Miyan are alleged to have assaulted Akhtar Hussain, son of the informant, but Akhtar Hussain got abrasion on his left leg and pain in chest and whole body. Other similarly situated co-accused have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 18336 of 2015 and Cr. Misc. No. 20544 of 2015. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Turkaulia (Banjaria) P.S. Case No. 407/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
