====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of regular bail for offence under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code.

According to first information report, the main assailant of the deceased, Sita Ram Prajapati, is co-accused, Krishna Prajapati. Though there is allegation against the petitioner also of commission of assault to Sita Ram Prajapati, however, the doctor had found single injury while performing post mortem examination.

Submission of the learned counsel for the petitioner is that similarly situated co-accused, Sanjay Parjapati, and others have already been allowed bail by coordinate Benches of this Court in Cr. Misc. No. 17934 of 2017 and Cr. Misc. No. 17384 of 2017.

The learned counsel for the informant opposed the prayer for bail.

Case No. 9 of 2017 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court.
