JUSTICE SATYAVRAT VERMA ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Nautan P.S. Case No. 382 of 2020 instituted for the offences under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.12.2020, charge-sheet has been submitted in the case, trial has commenced and has got two antecedents as mentioned in paragraph '3' of bail application. Learned counsel for the petitioner submits that allegation is of looting Rs. 50,000/- and mobile of the informant by three unknown criminals.

Learned counsel for the petitioner submits that the name of this petitioner transpired in the confessional statement

Patna High Court CR. MISC. No.50579 of 2021(2) dt.02-02-2022 2/2 of co-accused Bajrangi Lal and further the petitioner was not put on T.I.P. and no incriminating article was recovered from his possession.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.12.2020, charge-sheet has been submitted in the case, his name transpired in the confessional statement and nothing was recovered from his possession nor he was put on T.I.P., let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bettiah, West Champaran in connection with Nautan P.S. Case No. 382 of 2020 with a condition that one of the bailors shall be the father of the petitioner (Birendra Shukla @ Virendr Shukl). Further, if the petitioner on two consecutive dates does not appear in trial, the court below shall forthwith cancel his bail bonds. (Satyavrat Verma, J) Rishi/- U T
