JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-05-2022 Since petitioners no.4 and 5, namely, Abhinay Kumar and Munsi Prasad Sah have already been arrested by the police, this anticipatory bail application survives only against petitioners no.1, 2 and 3, namely, Kanchan Kumari, Pratima Kumari and Sangeeta Devi.

Heard both sides.

Petitioners No.1, 2 and 3, namely, Kanchan Kumari, Pratima Kumari and Sangeeta Devi apprehend their arrest in connection with Chapra Muffasil P.S. Case No.107 of 2021,

Patna High Court CR. MISC. No.50922 of 2021(3) dt.13-05-2022 2/3 registered for the offences punishable under Sections 341, 323, 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The petitioners are said to have tortured the informant physically and mentally for non-fulfillment of demand of additional dowry.

Learned counsel for the petitioners submits that petitioners no.1 and 2, namely, Kanchan Kumari and Pratima Kumari are the married Nanad and petitioner no.3, namely, Sangeeta Devi is the mother-in-law of the informant. It is further submitted that the husband has already been enlarged on anticipatory bail vide order dated 22.10.2021, passed in Cr. Misc. No.51841 of 2021. It is submitted that there is general and omnibus allegation against the petitioners.

Taking into consideration the facts aforesaid and the fact that the husband has already been enlarged on anticipatory bail, let petitioners no.1, 2 and 3, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Chapra, District Saran in

Patna High Court CR. MISC. No.50922 of 2021(3) dt.13-05-2022 3/3 connection with Chapra Muffasil P.S. Case No.107 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
