JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 272 and 273 of the Indian Penal Code and Sections 47(a)/50 of the Bihar Excise Amendment Act, 2016. Allegation against petitioners is that from the bush of Shisham tree, which is of petitioners, Mahua wine has been recovered It has been submitted on behalf of petitioners that they are in custody since 8.7.2016. They have got no criminal antecedent. There is no allegation of tampering of witnesses against petitioners. Recovery is said to have been made from the orchard. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.
