====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 25-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner, who is in custody, seeks bail in connection with Begusarai Muffasil P.S. Case No. 552 of 2017 registered for the offences punishable under Section 302 of the Indian Penal Code.
Informant is the cousin of deceased, who in his written complaint dated 04.12.2017 has stated that villager informed him that his cousin brother Malhu Mahton is lying dead and after receiving said information he went at the place of occurrence and was told by the nearby persons that on 29.11.2017 at about 11:00 P.M. there some altercation took place between Malhu Mahton and Tarjan Mahton (petitioner)
Patna High Court Cr.Misc. No.39028 of 2018(3) dt.25-08-2018 2/2 and Tarjan Mahton killed his cousin by strangulation. It has been submitted on behalf of the petitioner that he is innocent and alleged occurrence took place on 29.11.2017 and FIR was logged on 04.12.2017 except suspicion there is no incriminating material against the petitioner. Petitioner is also accused in Muffasil (Lakho O.P.) P.S. Case No. 543 of 2017 instituted under Section 341, 307 and 436/34 of the Indian Penal Code, except this case petitioner is not accused in any other case. It has been further submitted that petitioner has been arrested on the basis of suspicion only and he is in custody since 08.01.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S.
