====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2021 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in connection with Sahebganj P.S. Case No. 541 of 2019 dated 12.12.2019 instituted for the offence under Sections 414, 414 and 401 of the Indian Penal Code.
He is in custody since 13.12.2019.
It is alleged in the FIR that the petitioner and one Vimal Kumar Tiwari were arrested and they have disclosed the name of one Ajay Ray. Aforesaid Vimal Kumar Tiwari has been has been granted bail by a Bench of this Court vide order dated 26.06.2020 passed in Cr. Misc. No. 21046 of 2020.
The petitioner is said to have confessed before the police that he provided the information to co-accused
Patna High Court CR. MISC. No.37057 of 2020(2) dt.02-02-2021 2/2 Ajay Ray for stealing a motorcycle which was being driven by him and his associate.
Regard being had to the period of custody of the petitioner, nature of accusation and the fact that one of the similarly situated accused person has been granted bail, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, III, West Muzaffarpur in connection with Sahebganj P.S. Case No. 541 of 2019.
