Petitioner being brother-in-law of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.

The accusation is killing the daughter of the informant within two months of marriage for non-fulfilment of dowry demand. Subsequently half burnt dead body was recovered and husband of the victim confessed during investigation that he strangulated the victim. It is submitted by learned counsel for the petitioner that petitioner is resident of different place and he used to work in Punjab. The petitioner has been roped in since he happens to be the brother-in-law of the husband of the

Patna High Court Cr.Misc. No.31048 of 2015 (2) dt.04-08-2015 2/2 victim. Moreover a non-family member Ramchandra Mehta has been granted regular bail vide Cr. Misc. No. 47735 of 2013. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Tribeniganj P.S. Case No. 91 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The learned trial Court will be at liberty to cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial.
