The petitioner has preferred this application for grant of regular bail in a case registered under section 366A of the Indian Penal Code.

As per the prosecution case, the accused persons including the petitioner herein kidnapped the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The facts are otherwise. Referring to the contents of the statement of the daughter of the informant recorded under section 164 Cr.P.C. as also her examination as a witness in the trial in the learned trial Court, a certified copy of the deposition of which has been

No.50370 of 2021(3) dt.24-03-2022 2/2 produced, it is submitted by learned counsel that even accepting the informant's case for the sake of argument, the alleged victim is a major and she has categorically stated that she got married to the petitioner and is living in her sasural. The petitioner is in custody since 7.6.2021 and undertakes to cooperate in the trial. The certified copy of the deposition of the daughter of the informant be taken on record.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation and the statement of the daughter of the informant recorded under section 164 Cr.P.C., the Court directs the petitioner to be enlarged on bail in connection with Pari Bazar P.S. Case no. 62 of 2021 (GR no. 706 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate 2nd, Lakhisarai.
