JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/324/307/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that co-accused Amit Kumar fired on the informant but it did not hit him but, subsequently, coaccused, Manish Kumar fired which caused injury on the back of the informant. It is alleged against the petitioner that he was a member of the unlawful assembly.

It is submitted by learned counsel for the petitioner that neither any overt-act is alleged against the petitioner nor he carries any criminal antecedent as stated in paragraphs 8 and 3 of the petition.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.32464 of 2015 (2) dt.10-08-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil P.S. Case No.18 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
