Petitioners seek bail in Kajara P.S. Case No.62 of 2018 instituted for the offence under Section(s) 307 and other allied sections Indian Penal Code.

Counsel for the petitioners submits that instant case is counter blast of Kajara P.S. Case No.63 of 2018 lodged by petitioner No.1 against informant and her family members. In the written report, it is alleged that on the date of occurrence on the order of petitioner No.1 other accused, as named in the written report, assaulted the informant and others, as mentioned in the written report, with intention to cause

Patna High Court CR. MISC. No.40154 of 2019(3) dt.30-08-2019 2/2 communal disharmony. It is further alleged that in the instant case three persons, namely, Siraj, Jalal and Md. Fahim sustained injuries.

In the written report, there is no allegation of specific overt act against the petitioners. There is general and omnibus allegation against the petitioners.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Kajara P.S. Case No.62 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
