M/s Vishal Pd, Tripti Singh, Advocates ====================================================== CORAM: HONOURABLE MR JUSTICE RANJAN KUMAR JHA ORAL ORDER 13-07-2026 Heard learned counsel for the petitioners, learned counsel for the informant and the learned APP. 2 This application has been filed on behalf of the petitioners for grant of anticipatory bail, who are apprehending their arrest in connection with Pipra PS Case No 99 of 2026 dated 05.03.2016 registered for the offence punishable under Sections 126 (2), 115 (2), 118 (2), 109 (1), 303 (2), 76, 352, 351
(2) and 3 (5) of the BNS.
Patna High Court CR. MISC. No.43013 of 2026(2) dt.13-07-2026 2/3 3 FIR, in nutshell, is that a dispute arose on account of some untoward behaviour shown by the accused side to the niece of the informant Ruchi Kumari who is eight years old. When the informant side protested, the accused, armed with lathi, danda, dabiya, iron rod, farsa, sword and knife assaulted the informant side indiscriminately causing injuries to them. 4 The learned counsel for the petitioners submits that there is land dispute between the parties and also there is case and counter case and the FIR version is nothing but an exaggerated version of some scuffle between the parties which finds support from the fact that the learned Court below, in its order sheet, recorded the nature of injuries as simple. 5 The learned APP and the learned counsel for the informant vehemently opposed the prayer for bail. Having considered the rival submissions, particularly in view of case and counter case coupled with the nature of injuries, I am inclined to grant anticipatory bail to the petitioners.
7 Let the petitioners above named, in the event of their arrest/surrender within a period of four weeks from today, be released on bail on each of them furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the

No.43013 of 2026(2) dt.13-07-2026 3/3 like amount each to the satisfaction of learned SDJM, Sadar Motihari, East Champaran in Pipra PS Case No 99 of 2026 subject to all conditions as laid down under Section 482 (2) of the BNSS and also with a condition that the petitioners shall cooperate with the trial and any deliberate attempt on the part of the petitioners to delay the trial will entitle the informant to file appropriate application before the Court below for cancellation of their bail bonds.
