Petitioners are apprehending arrest in connection with a case registered for the offences under Sections 379, 427/34 of the Penal Code in connection with theft of idle of Lord Hanuman as also Rs. 8,000/- from the donation box of the temple. It is submitted on behalf of the petitioners that their land is situate by the side of the temple, which the temple management encroached to amalgamate with the temple land and he is resisting the same. In this connection, it is submitted that petitioners filed application dated 23.05.2014 before the SubDivisional Magistrate, on the basis of which a proceeding under
Patna High Court Cr.Misc. No.48393 of 2014 (3) dt.21-05-2015 2/2 Section 144 Cr.P.C. was initiated and during pendency of the proceeding the present case has been lodged.
Let petitioners, named above, surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand Only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No.309/2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
