The petitioner seeks bail in connection with Pipra P.S. Case No. 16 of 2017, registered under Section 302 and 120-B of the Indian Penal Code.
The accusation is that on 18.01.2017 after taking the dinner daughter of the informant slept in the house and on the next morning her dead body was found in the bamboo clamps of Raj Kumar Mandal situated near the primary school. The informant raised suspicion against the petitioner and five others named in the F.I.R., who committed murder of her daughter moving from her house under conspiracy as they were doing meeting for 4-5 days in the night at school.
Learned counsel for the petitioner submits that it
Patna High Court Cr.Misc. No.22330 of 2017 (3) dt.29-06-2017 2/2 would appear from the F.I.R. itself that informant is not the eyewitness of the occurrence, rather he disclosed the name of petitioner and other co-accused due to earlier civil dispute. Further submission is that petitioner has no criminal antecedent is in custody since 20.01.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in connection with Pipra P.S. Case No. 16 of 2017.
