Petitioner, already in custody, seeks bail in connection with Naubatpur P.S. Case No. 133 of 2017 registered under Sections 302, 120(B) and 34 of the Indian Penal Code. Allegation in brief is that the father of the informant was called by the petitioner for collecting the money and thereafter did not return back and next day he was found killed. Learned counsel for the petitioner submits that except that the petitioner is said to have called the deceased and subsequently the confessional statement made before the police by the petitioner, he has been made accused in this case and it is alleged that country made pistol was recovered from the

No.19432 of 2018(3) dt.25-06-2018 2/2 courtyard of the petitioner but ballistic report does not indicate that arms was used for firing and this petitioner has no criminal antecedent and has been in custody for last one year. Having considered the aforesaid facts and circumstances, petitioner Nauvind Singh @ Nauvin Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Danapur, Patna in connection with Naubatpur PS Case No.133 of 2017 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
