JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 414 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

Allegation against petitioner is that in course of vehicle checking petitioner was apprehended and from his possession arms was recovered.

It has been submitted on behalf of petitioner that he is in custody since 8.5.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. One country made pistol along with two cartridges are said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. It has been further submitted that petitioner may be released after completion of six months in custody, i.e., from 8.5.2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.42281 of 2016 (2) dt.03-10-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody, i.e., from 8.5.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 6th Additional Chief Judicial Magistrate, East Champaran at Motihari, in connection with Mehshi P.S. Case no. 61 of 2016.
