The petitioner has prayed for bail in connection with Sahar P.S. Case No. 14 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 379, 504 and 506 of the Indian Penal Code.

As per allegation in the F.I.R., as a result of some altercation between the children, petitioner and other accused persons assaulted the brother of the informant as a result of which he sustained injuries and fell unconscious. It is submitted by the learned counsel for the petitioner that from perusal of the FIR it transpires that there is specific allegation to the effect that on the orders of Laddu Sah, four named accused persons, namely, Narad Sah, Sunil Sah,

Patna High Court CR. MISC. No.41366 of 2019(3) dt.13-09-2019 2/2 Aman and Anup assaulted the informant's brother. No specific overt act is alleged against the petitioner. He is in custody since 27.02.2019 and has no criminal antecedent.

Having heard the learned counsel for the parties and taking into consideration that no specific overt act has been alleged against the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateX, Bhojpur at Ara in connection with Sahar P.S. Case No. 14 of 2019.
