The petitioners seeks bail in Madhubani Town P.S. Case No. 256 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.
Allegation against the petitioners is of committing theft of motorcycle It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case on mere suspicion and nothing has been recovered from the possession of the petitioners. It has been further submitted that the FIR is against unknown. Petitioners have been made accused
Patna High Court Cr.Misc. No.38551 of 2018(3) dt.24-08-2018 2/2 on the basis of their self confession before the police as they are accused in other cases as mentioned in paragraph no. 3 of the petition. Except their own confession there is no incriminating material against the petitioners. Similarly, situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 11.05.2018 passed in Criminal Miscellaneous No. 22270 of 2018. Petitioners are in custody since 28.11.2017 Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No. 256 of 2017.
