Petitioner seeks bail in Pothia P.S. Case No.156 of 2018 instituted for the offence under Section(s) 379 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. No incriminating article has been recovered from his possession. During investigation, the police arrested the petitioner and recorded his confessional statement and remanded him in the instant case merely on suspicion.

Counsel for the petitioner submits that Petitioner is in

Patna High Court CR. MISC. No.37621 of 2019(2) dt.25-06-2019 2/2 custody since 29.112018.

Counsel for the State submits that petitioner has criminal antecedents.

Keeping in view the period of custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st, Kishanganj, in connection with Pothia P.S.
