JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barauni (Refinery) P.S. Case No. 284 of 2016 instituted for the offence under Sections 467, 468, 471, 420, 120(B)/34 of the Indian Penal Code, Sections 25(1-b)A, 26 and 35 of the Arms Act.
It has been submitted that petitioner has no criminal antecedent. He was working as a Guard in CMS Company. The alleged firearm has been provided to him by the Company itself. It has further been submitted that co-accused Shambhu Yadav with similar allegation has already been granted bail by a coordinate Bench of this Court vide order dated 10.2.2017 passed in Cr. Misc. 50121 of 2016.
Petitioner is said to be in custody since 28.7.2016
Patna High Court Cr.Misc. No.9630 of 2017 (3) dt.21-06-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Refinery) P.S.
