2. Petitioner seeks regular bail in connection with Bairgachhi P. S. Case No. 79 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, 26.400 liters of English liquor were recovered from the house of the petitioner.
4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion. No incriminating material has been recovered from conscious possession of the petitioner. Petitioner is in custody since 25.04.2025. Petitioner fairly submits that except for this case, he is accused in five
Patna High Court CR. MISC. No.41896 of 2025(2) dt.08-08-2025 2/2 more cases, but he is on bail in all those cases.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-I, Araria in connection with Bairgachhi P. S. Case No. 79 of 2024.
