2. The petitioner is apprehending arrest in connection with Bahadurpur P.S. Case No. 316 of 2021 registered on 12.10.2021 for the offenses punishable under Sections 419 and 420/34 of the Indian Penal Code.

3. As per the prosecution, it has been alleged that the apprehended accused person disclosed during examination that he had been hired by the petitioner to appear in the examination on his behalf.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner has a clean antecedent and the present

Patna High Court CR. MISC. No.38980 of 2025(2) dt.25-06-2025 2/2 case has been lodged under a misunderstanding. It is contended that the petitioner had gone to the washroom during the examination, and in his absence, the examiner lodged the present case under a mistaken impression.

5. Learned APP for the State vehemently opposes the prayer for bail and submits that the defence taken by learned counsel for the petitioner is not tenable, as in a competitive examination, no candidate is permitted to leave the examination hall for any reason, including to use the washroom.

6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Bahadurpur P.S. Case No. 316 of 2021, pending before the learned Judicial Magistrate, 1st Class, Patna City, is hereby rejected.
