In this case, the petitioners are apprehending their arrest in connection with Cheriya-Bariyarpur P.S. Case No. 37 of 2019 registered for offences under sections 30(a) & 30(F) of the Bihar Excise (Prohibition) Amendment Act, 2016. In the present case, the police has recovered 5 liters of Mahua wine from the house of petitioner no.1 and 10 liters Mahua wine from the house of petitioner no.2. The petitioners have criminal antecedent of similar nature of offence.

Looking to the entire facts and circumstances of the

Patna High Court CR. MISC. No.37727 of 2019(2) dt.21-06-2019 2/2 case as also the petitioners having criminal antecedent of similar nature, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected.

If the petitioners surrender before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
