1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Mashrak P.S. Case No. 711 of 2020 dated 29.12.2020 registered for the offence under Section 394 of the I.P.C.

3. As per the first information report in the night of 28/29-12-2020 in the wee hours three persons looted Maruti Swift Dzire vehicle of the informant bearing registration no. BR-01-EX-0765 while he was going to Gorakhpur from Patna to meet his friend. The accused persons on the point of pistol also snatched cash of Rs. 8,000/- of the informant.

4. Learned counsel for the petitioner submits that F.I.R. is against unknown and the name of the petitioner has transpired on the basis of confessional statement of the co-accused before the police much after the date of occurrence. Except

Patna High Court CR. MISC. No.40179 of 2025(2) dt.16-07-2025 2/2 confessional statement of the co-accused there is no cogent evidence against the petitioner. Investigation in the case is still going on.

Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that the petitioner is having criminal antecedent of serious nature of offence and his name has transpired in the confessional statement of the co-accused which may lead to further investigation by the police and investigation in the case is still going on, as such, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected.
