JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and 47 of the Excise Act.
Twelve litres of country-made liquor and 10 litres sprit are said to have been recovered from house of the petitioner but admittedly, the petitioner was neither caught on the spot nor the aforesaid recovery was made in his presence. The petitioner is languishing in jail custody since 03-05-2016 and does not have any criminal antecedent.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.42512 of 2016 (2) dt.06-10-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sadar (Muffasil) P.S. Case No. 96 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Purnea. (Hemant Kumar Srivastava, J) A.K.V./- U T
