This is the second attempt of the petitioner for seeking bail as earlier by order dated 08.10.2020 in Cr. Misc. No.13955 of 2020, the bail application of the petitioner was rejected with an observation "for the present".

The learned counsel for the petitioner submits that the petitioner is in custody since 29.07.2019, he is a person with clean antecedent and co-accused Rajesh Ram has been granted anticipatory bail by order dated 11.01.2022 in Cr. Misc. No.24675 of 2021.

In view of the submissions made by the learned counsel for the petitioner, status of the case was called for from the learned trial Court by order dated 08.02.2022, the same has

Patna High Court CR. MISC. No.51780 of 2021(3) dt.03-03-2022 2/2 been received vide Letter No.150 dated 26.02.2022 issued in the signature of the learned 1st Additional District & Sessions Judge, East Champaran, Motihari.

From perusal of the same, it would manifest that charges against the petitioner has been framed on 22.12.2021 and altogether 09 witnesses are there in the case and summons have already been issued against the witnesses on 21.02.2022. Considering the period of custody of the petitioner and the fact that co-accused Rajesh Ram has been granted anticipatory bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Pipra P. S. Case No.130 of 2019. The application stands allowed.
