JUSTICE S. KUMAR ORAL ORDER 25-09-2018 Heard learned counsel for petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Digha P.S. Case No. 186/2018, registered for the offences punishable under Sections 406, 420, 468, 120(B) and 34 of the Indian Penal Code and sections 66, 67 of Information Technology Act. It is alleged that petitioner and Sunil Kumar Jha were running a firm namely, Indira Vikas Research and Development Partnership firm. They were partners of that firm. They used to provide machines on low price and also assist in providing the bank loan. Petitioner paid Rs. 6,51,000/- in cash and cheque for machine, but neither machine was provided nor money was refunded to him.

Patna High Court Cr.Misc. No.43265 of 2018 (5) dt.25-09-2018 It has been submitted that petitioner has falsely been implicated in this case. Sunil Kumar Jha took the money and gave receipt of the same to the petitioner.

Petitioner is directed to pay Rs. 1,51,000/- to the informant namely, Kumar Sanjay within one month from his release from jail, by cheque, Bank Draft or R.T.G.S. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on provisional bail for a period of one month on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 186/2018 and on making payment of amount of Rs. 1,51,000/- to the complainant Kumar Sanjay within one month of release the Provisional Bail granted to petitioner shall be made absolute.
