This application for anticipatory bail arises out of Sangrampur P.S. Case No. 162 of 2020 for the offence punishable under Sections 306 & 328/34 of the Indian Penal Code.

In view of the fact that the petitioner no.2 and 3 are son and daughter-in-law of the deceased, I am inclined to grant them anticipatory bail. Let the petitioner nos. 2 and 3, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties

Patna High Court CR. MISC. No.37332 of 2020(4) dt.23-11-2021 2/2 of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran, in connection with Sangrampur P.S. Case No. 162 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. So far as petitioner no.1 is concerned, his prayer for anticipatory bail is rejected considering the allegation levelled against him. However, if the petitioner no.1 surrenders in the Court below within four weeks and seeks regular bail, the Court below shall consider and decide the same in accordance with law without being influenced by this order.
