JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the deceases is languishing in jail custody since 13.11.2014 in a case registered under Sections 304B/201 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

Admittedly, the prayer for bail of the petitioner was earlier rejected by this Court vide order dated 26.11.2015 passed in Cr. Misc. No. 23257 of 2015 directing the trial court to expedite the trail of the petitioner but the trial court has reported that up till now seven prosecution witnesses could be examined. However, the trail court has not given the number of non examined witnesses in his report and it is informed on behalf of the petitioner that three prosecution witnesses including investigating Officer are yet to be

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas in connection with Kochas ( Parsathus) P.S.Case No. 78 of 2014.
