JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Athmalgola P.S. Case No. 53 of 2014 instituted for the offence under Sections-363, 302, 201/120B of the Indian Penal Code.
As per written report, the petitioner along with other accused persons as named in the written report caught hold Ranjeet Yadav, the brother of the informant, on the point of pistol and carried him out towards the ridge. The informant out of fear went to the village of his Fufa and informed regarding the incident. The family of the informant was also informed. Thereafter, search was made and on the next day, decomposed dead body of Ranjeet Yadav, the brother of the informant was recovered. It is further alleged that the deceased had performed
Patna High Court Cr.Misc. No.19821 of 2017 (3) dt.21-06-2017 2/2 marriage with daughter of co-accused Upendra Yadav, for which, the accused persons were annoyed with him.
It has been submitted that co-accused Upendra Yadav has already been granted privilege of bail by a coordinate bench of this court by order dated 07-04-2016 passed in Cr. Misc. No. 2626 of 2016.
From the written report, the allegation against this petitioner appears to be of last seen.
In such circumstances, this prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Athmalgola P.S. Case No. 53 of 2014 corresponding to Sessions Trial No. 729A of 2015 to the satisfaction of learned Additional Sessions Judge-II, Barh, Patna subject to condition that both the bailors should be close relatives of the petitioner.
