2. The petitioner seeks bail in connection with Sour Bazar P.S. Case No. 489 of 2022 registered for the offence under Sections 25(1-A), 25(1-AA), 25(1-B), 26, 35, 25(1-B) of the Arms Act.

3. As per the prosecution case, it has been alleged that the arms have been recovered from the back side of the house of the petitioner.

4. The learned counsel for the petitioner submits that the petitioner is not, in any way, related with the alleged recovery. The petitioner is in custody since 24.06.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.41729 of 2025(2) dt.16-07-2025 2/2 the learned ACJM-II, Saharsa/concerned Court below in connection with Sour Bazar P.S. Case No. 489 of 2022.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Sour Bazar (Patarghat O.P.) Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As the petitioner claims to have only two criminal antecedents i.e. Sour Bazar (Patarghat O.P.) P.S. Case No. 323 of 2023 and Patarghat P.S. Case No. 125 of 2024, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case, except the aforesaid two cases, then the bail bonds of the petitioner shall not be accepted. If the petitioner is found to be involved in only two aforesaid cases along with the present case then his bail bonds shall be accepted.
