The petitioner seeks bail in Chiksaura P.S. Case No. 26 of 2018 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Allegation against the petitioner is of causing death of the sister of the informant due to non fulfillment of dowry demand.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case being the Brother-in-law (Nandosi) of the deceased. Petitioner has got no criminal antecedent and is in custody since 08.06.2018. Similarly, situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 10.07.2018 in

Patna High Court Cr.Misc. No.38729 of 2018(3) dt.24-08-2018 2/2 Criminal Miscellaneous No. 36459 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Hilsa, Nalanda, in connection with Chiksaura P.S. Case No. 26 of 2018.
