JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bihra P.S. Case No. 76 of 2014 instituted for the offence under Sections-498A, 370, 365/34 of the Indian Penal Code.

The petitioner is husband of the victim.

As per written report, the petitioner performed marriage with daughter of the informant one and half years back by disclosing his wrong caste. After performing marriage, the petitioner started giving mental and physical torture to her. The elder son of the informant went to Sasural of the victim girl but the victim girl was not found there. The petitioner and his other family members told that she has gone to her Naihar but she was not found there also. The informant alleged that he could not trace out

Patna High Court Cr.Misc. No.19037 of 2017 (3) dt.21-06-2017 2/2 his daughter. The petitioner is husband of the victim girl, who is traceless from her Sasural since the year, 2014 and till date, there is no trace of the victim.

In such circumstances, this court is not inclined to release the petitioner on bail at this stage. Accordingly, prayer for bail of the petitioner is rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within nine months from the date of receipt/production of copy of this order.
