Petitioner seeks bail in Laxmipur P.S. Case No. 22 of 2018 registered for the offence punishable under Sections 399, 402, 307, 412/34 of the Indian Penal Code and 25(1-b), 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of one loaded Katta with two live cartridges along with some silver ornaments and one T.V.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on mere suspicion. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 05.09.2018 passed in Criminal Miscellaneous No. 44643

Patna High Court Cr.Misc. No.41943 of 2018(4) dt.12-09-2018 2/2 of 2018. Petitioner is in custody since 23.01.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jamui, in connection with Laxmipur P.S. Case No. 22 of 2018.
